Schooling Terms of Service

Horse owners must view the paddock their horse will be residing in during its stay at Te Rangi Equestrian and confirm they are satisfied with the boarding paddock for their animal during its stay. Confirmation of this is made by signing the no liability disclaimer form and/or purchasing schooling on behalf as offered by Te Rangi Horses.

Horses booked for schooling - minimum 2 weeks stay.

Horses that are to reside at Te Rangi Equestrian must have their general maintenance up to date and suitable for schooling purposes including :

-freshly shod

-teeth maintained

-recently wormed

-vaccinated as and where appropriate

-supplied with suitable covers for the current season.

-feed should be supplied preferably pre mixed including supplements ready to feed.

Riding Lessons, Horsemanship lessons and Clinics Terms of Service

Riders, lesson participants, clinic participants, users of the Te Rangi Horses fitness trail package and all ground users including accompanying persons ride and participate at Te Rangi Equestrian at their own risk. The owners of Te Rangi Equestrian and surrounding farms including 167 Gillespie road and 168 Gillespie road accept no liability for accident, injury, death, damages to vehicles or property of any kind.

Riding lessons & Horsemanship lessons must be paid for at the conclusion of the lesson or within 7 days via invoice.

All Te Rangi Equestrian clinics must be paid for in full 7 days prior to the clinic date.

Hazards at Te Rangi Equestrian include but are not limited to :

-wildlife and farm animals including birds such as pukekos, pheasants, magpies, plovers, wood pigeons, cattle, dogs.

-landscape that includes tomos ( holes in the earth due to underground water ), slips, steep sidelings, steep and rolling paddocks, ponds, ditches, trees and bush areas

-driveways that are frequented by cars, tractors, motorbikes, farmstock such as cattle, other riders and horses

Users of property must always ensure :

-any gates passed through on the property are left as they are found

-Floats and trucks are parked well off the driveway on the sideling next to the arena to allow plenty of room for passing cars.

-Horses are groomed / tacked up in a yard or on the concrete hosing bay inside the property. No tacking up of horses on the driveway where trucks / floats are parked is permitted at any time. 

-Yards and tack up areas are left as they are found and all hay & manure is removed.

-Any damages incurred to property at Te Rangi Equestrian ( including proerty at 165 and 167 Gillespie Rd, Hunua ) is reported and reimbursed by the client / ground user.

 

Liability for lessons, schooling of horses, clinics at Te Rangi Equestrian and all ground users of Te Rangi Equestrian and all lessons offered by Te Rangi Horses / Ashra McAvinue at any location :

Neither Te Rangi Horses / Te Rangi Equestrian, nor any volunteer, sponsor or service provider on the grounds at 165A and 167 Gillespie Rd, Hunua, Auckland, including the facilities made at that address, is liable :

  1.  To any rider, owner, spectator or any person supporting, or otherwise attending the grounds of Te Rangi Equestrian for any personal injury, accident, harm, incapacity or death, arising in connection with a Te Rangi Equestrian ground user/ client being present at or using facilities on Te Rangi Equestrian grounds for any purpose or
  2. For any injury, accident, harm, incapacity or death, or damage to or destruction of, any property of, or being used by, the Te Rangi Equestrian ground user, including any animal or vehicle, arising in connection with a Te Rangi Equestrian ground user or client.
  3. To any owner who has placed their horse at Te Rangi Equestrian for the purpose of schooling and riding, for injury, incapacitation or death
No claim or proceedings

    The Te Rangi Equestrian ground user/client/horse owner must not make any claim, or commence or pursue any proceedings against any Te Rangi Equestrian party in respect of any fact, matter or circumstance arising out of or in connection with the participant/client using Te Rangi Equestrian grounds, participating in a Te Rangi Equestrian lesson or placing their horse at Te Rangi Equestrian for schooling and agistment. This includes respect of any injury, accident, harm, incapacity or death of or to the Te Rangi Equestrian ground user/client or horse placed for adjustment/schooling, or damage to or destruction of any Te Rangi Equestrian ground user/client property. This applies to the property and grounds at both 165A Gillespie Rd, Hunua and 167 Gillespie RD, Hunua.

    By participating in a lesson, trail rider, clinic or any other activity advertised by Te rangi Equestrian / Te Rangi Horses you hereby assume all of the risks of participating in the lesson, trail ride or clinic, including by way of example and not limited to, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained or controlled by them, or because of their possible liability without fault. You certify that you are physically fit and have not been advised to not participate by a qualified medical professional. You certify that there are no health-related reasons or problems which preclude your participation in the Te Rangi Equestrian / Te Rangi Horses clinic, lesson, trail ride or other activity.  You acknowledge that this Accident Waiver and Release of Liability Form will be used by the organisers of all Te Rangi Horses activities in which you may participate and that it will govern myour actions and responsibilities at said Equestrian clinic/lesson.

    In consideration of my application and permitting me to participate in this Equestrian clinic/lesson/trail ride/activity, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows: (A) I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from this Equestrian clinic / lesson/ trail ride / activity.

    THE FOLLOWING ENTITIES OR PERSONS: Ashra McAvinue, Te Rangi Horses. (B) I acknowledge that this Equestrian Clinic / lesson / trail ride / activity may carry with it the potential for death, serious injury, and personal loss. The risks may include, but are not limited to, those caused by horses, other animals on the premises, facilities temperature, weather, condition of participants, equipment, actions of other people including, but not limited to, participants, volunteers, spectators, coaches. By purchasing a lesson / trail ride / clinic or other activity I waive any rights, claims or interest and I understand that there will be no financial or other remuneration. The accident waiver and release of liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law. I CERTIFY THAT I HAVE READ THIS DOCUMENT, AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I ACCEPT IT ON MY OWN FREE WILL.

    If the lesson is purchased by a parent or guardian they further agree to save and hold harmless and indemnify each and all parties referred to above from all liability, loss, cost, claim, or damage whatsoever which may be imposed upon said parties on behalf of the child or persons under 16 years of age.

     

    1. Release and Discharge

    The Te Rangi Equestrian ground user / client releases and discharges the Te Rangi Equestrian parties from all claims, demands and causes of action, arising out of or in connection with the Te Rangi Equestrian client using Te Rangi Equestrian services or grounds, including in respect of any injury, accident, harm, incapacity or death of or to the Te Rangi Equestrian client/ground user or horse adjisted with Te Rangi Equestrian or any Te Rangi Equestrian client property, or damage to or destruction of, any Te Rangi Equestrian client property.

    By riding at Te Rangi Horses in any lesson, clinic, trail ride or activity OR by riding in a lesson offered by Te Rangi Horses in a location that is not Te Rangi Equestrian at 165A or 167 or 168 Gilles pie Raod, Hunua, Auckland - you agree to abide by our liability terms.

    Conditions of Entry and Participation

    Bookings must be accompanied by a 50% non-refundable payment.

    The total amount per one-day clinic is $215. A booking payment of $107.50 is required to confirm the space.

    Entries can be made by emailing terangihorses@gmail.com or buying a space via the website.

    NOTE - Clinics are non-refundable

    If your horse is injured or unwell and you cannot attend a vet certificate must be provided and you can transfer your booking to another clinic date. This must be used within one year from the booked clinic.

    If you become unwell and cannot attend a medical certificate must be provided and you can transfer your booking to another clinic date. This must be used within one year from the booked clinic.

    The arena is uncovered, and clinics are often held over the winter period – you need to be prepared to go ahead in all weather. Clinics will not be canceled due to rain.

    The Te Rangi Horses waiver form and questionnaire must be fully filled out and signed to attend.

    While on-site at Te Rangi Horses : 165A Gillespie rd, Hunua – you are fully responsible for the welfare of your horse and to ensure you do not cause harm or damage to other clinic participants’ horses, persons, or property. Please ensure you bring ample hay and feed for your horse for the duration of the clinic.

    There are facilities available for use during the clinic including 2 loose boxes, a concrete yard, hose and paddocks. You are responsible to leave these as you found them before leaving the property including all hay and manure removed.

    Parking is limited to the driveway of the property. Please ensure you park closely behind the stables on the right-hand verge. Strictly no tying of horses to floats or trucks on the driveway – horses must be tacked up inside the property either at the hitching rail or inside the loose boxes.

    There is no mucking out of floats onto the property. Participants must not muck out flats or trucks onto the property. What arrives with you in your float / truck must go home with you.
